1. Acceptance of These Terms
These Terms of Use ("Terms") govern your access to and use of ParkEngine Pro (the "Service"), a web-based parking-structure schematic design calculator, together with its associated marketing site, account dashboard, and billing tools (collectively, the "Site"). The Service is operated by F.E. Santiago Management Consultancy, a sole proprietorship registered with the Philippine Department of Trade and Industry under Business Name Registration No. 6192464, doing business under the sole proprietor Ferdinand Santiago ("FESMC," "we," "us," or "our").
By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
2. Description of the Service
ParkEngine Pro lets a signed-in user enter site, program and code parameters for a parking structure and receive computed outputs covering structural framing sizing, seismic and wind demand, snow loading and components & cladding pressures where applicable, vehicle circulation and stall-count checks including ADA-accessible stall counts, traffic and queuing screening, MEPF allowances, a bill of quantities (BOQ), and a schematic cost plan. Projects can be saved to your account and exported as PDF and Excel files, subject to the plan limits described in Section 5.
The Service is delivered as-is at whatever scope and feature set is published on the Site at the time you use it. We may add, change, or remove individual calculators, checks, export formats, or other features at any time, including features described in these Terms, without those changes reducing your rights to a refund or credit except as Section 6 provides.
3. Eligibility and Accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. By registering, you represent that the information you provide is accurate and that you have the authority to enter into these Terms, whether for yourself or on behalf of an organization.
Accounts are accessed through a passwordless, one-time sign-in link emailed to the address you register with — we never ask for or store a password for your ParkEngine Pro account. You are responsible for maintaining control of the email inbox tied to your account and for all activity that occurs under it. Notify us immediately at projects@fesmc.com.ph if you believe your account has been accessed without authorization.
4. Engineering Disclaimer
ParkEngine Pro is a schematic-level design aid, intended to help structural engineers, developers, and consultants screen options and size a scheme quickly during early design. Its outputs — including all structural member sizes, load computations, seismic and wind demand figures, ADA stall counts, traffic and queuing screening results, cost estimates, and the contents of the built-in Project Readiness panel — are computed estimates based on the inputs you supply and the assumptions and code provisions built into the tool.
They are not, and must never be treated as, any of the following:
| Not a substitute for licensed review | A sealed, signed, and stamped calculation package or construction document set prepared and reviewed by a Professional Engineer or Architect licensed in the jurisdiction of the project. |
| Not code-official approval | A representation that a scheme will be approved by any building department, code official, or authority having jurisdiction. |
| Not a guarantee of buildability or cost | A guarantee that the computed scheme is constructible as shown, or that actual construction cost will match the schematic cost plan. |
| Not geotechnical, MEPF, or life-safety design | A substitute for site-specific geotechnical investigation, detailed mechanical/electrical/plumbing/fire-protection design, or life-safety and egress analysis by the applicable licensed disciplines. |
You are solely responsible for having any output independently reviewed, verified, and — where required by law or by the standard of care applicable to your project — sealed by a licensed Professional Engineer or Architect before it is relied on for permitting, procurement, or construction. Use of the Service does not create an engineer-client, architect-client, or any other professional-services relationship between you and FESMC or Ferdinand Santiago.
5. Plans, Billing and Payment
Every account starts on the free tier, which allows one saved draft project with full calculation access; PDF and Excel export are unlocked on a paid plan. The current plans, pricing, and what each includes are published on our Pricing page and are incorporated into these Terms by reference. As of the date above, three plans are offered:
| One-Time Use | A single payment that permanently unlocks one additional saved project slot and export for that project. Not a subscription; no recurring charge. |
| Studio (monthly) | Unlocks unlimited saved projects and exports for a 30-day period from the date your payment is verified. Access continues only if you submit and we verify a new payment before or shortly after that period ends — it does not renew automatically. |
| Practice (yearly) | The same unlimited access as Studio for a 365-day period, at the discounted annual rate, renewed the same manual way. |
All plans are priced in Philippine Pesos (PHP) and paid by bank transfer, GCash, or Maya — shown at checkout as a QR code and account details. There is no card processor or payment gateway in the loop: we never receive, process, or store any card, bank login, or e-wallet credential of yours. Instead, you send the payment yourself through your own bank or e-wallet app, tell us how to identify it (sender name, reference number, or amount), and a member of our team manually checks our account for a matching incoming payment before unlocking your plan — usually within one business day. Because verification is manual, Studio and Practice access is granted for a fixed period (30 or 365 days) rather than auto-renewed, and we will not change a plan's price without posting the new price on the Pricing page before you pay for a new period.
6. Renewal and Refunds
Studio and Practice access simply lapses at the end of its paid period unless you submit a new payment claim beforehand — there is nothing to "cancel," since nothing charges automatically. You can submit a renewal at any time from the Billing page, including after your access has lapsed; a verified renewal restores unlimited access immediately. We do not provide prorated refunds for an unused portion of a paid period, except where required by applicable law.
One-Time Use purchases are, by their nature, a single permanent unlock rather than a recurring charge, and are non-refundable once the purchased project slot has been used to generate an export. If you believe a payment you sent was not correctly matched to your account, or a One-Time Use purchase failed to unlock as described, contact projects@fesmc.com.ph within thirty (30) days of sending payment and we will investigate in good faith. Nothing in this section limits any non-waivable refund right you have under the Philippine Consumer Act (Republic Act No. 7394) or other applicable consumer-protection law.
7. Your Project Data
The inputs you enter and the outputs the Service computes for your projects ("Project Data") remain yours. We do not claim ownership of Project Data, and we do not use it to train any model or share it with other users. Project Data is stored so it can be reloaded into the calculator on your next visit and so exports can be regenerated; see our Privacy Policy for exactly what is stored, where, and how access to it is controlled.
You are responsible for the accuracy of the inputs you provide and for ensuring you have the right to use any site, program, or client information you enter into the Service. Deleting a project from your dashboard removes it from active use; see the Privacy Policy for how deletion is carried out.
8. Acceptable Use
You agree not to:
| Circumvent access or billing controls | Attempt to bypass, disable, or manipulate account authentication, project limits, or export entitlement checks other than through the Billing page and normal plan purchase. |
| Interfere with the Service | Probe, scan, or test the vulnerability of the Service, or introduce malware, or attempt to disrupt its availability or performance for other users. |
| Misrepresent outputs | Present ParkEngine Pro's schematic outputs to a third party as sealed, licensed engineering work product without the independent professional review described in Section 4. |
| Reverse engineer | Decompile, reverse engineer, or attempt to extract the source code of the Service, except to the extent applicable law expressly permits this despite the restriction. |
| Resell access | Resell, sublicense, or provide access to your account or the Service to third parties outside your own organization without our prior written consent. |
We may suspend or terminate accounts that violate this section, as described in Section 13.
9. Intellectual Property
The Service — including its calculation engine, software, design, text, graphics, and the "ParkEngine Pro" name and logo — is owned by FESMC or its licensors and is protected by Philippine and international intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your own or your organization's internal design work. No other rights are granted, and nothing here transfers ownership of the Service to you.
10. Third-Party Services
The Service relies on third-party infrastructure providers to operate, including hosting, database, email, and payment processing services. Their use of information is governed by our Privacy Policy and by their own terms. We are not responsible for outages or failures originating in a third-party provider's systems, though we will work to restore service and communicate with affected users where practical.
11. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT WHERE SUCH A DISCLAIMER IS NOT PERMITTED BY LAW. WE DO NOT WARRANT THAT COMPUTED OUTPUTS ARE ERROR-FREE, THAT THE SERVICE WILL BE UNINTERRUPTED, OR THAT IT WILL MEET YOUR SPECIFIC PROJECT REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FESMC AND FERDINAND SANTIAGO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE OR RELIANCE ON ITS OUTPUTS — INCLUDING ANY DAMAGES ARISING FROM CONSTRUCTION, PROCUREMENT, OR DESIGN DECISIONS MADE WITHOUT THE INDEPENDENT PROFESSIONAL REVIEW DESCRIBED IN SECTION 4 — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIVE THOUSAND PHILIPPINE PESOS (₱5,000). Nothing in this section limits liability that cannot lawfully be limited, such as liability for gross negligence, willful misconduct, or fraud.
12. Indemnification
You agree to indemnify and hold FESMC and Ferdinand Santiago harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service in violation of these Terms, your violation of applicable law, or your use of Service outputs in construction or permitting without the independent professional review described in Section 4.
13. Suspension and Termination
You may stop using the Service and close your account at any time by contacting projects@fesmc.com.ph. We may suspend or terminate your access if you materially breach these Terms, including the Acceptable Use section, or if we reasonably believe your account poses a security risk to the Service or other users. Where practical, we will give you notice and an opportunity to cure before termination. Sections 4, 7, 9, 11, 12, and 15 survive termination of these Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of the Philippines, including the Civil Code of the Philippines, the Consumer Act (Republic Act No. 7394), and the Electronic Commerce Act (Republic Act No. 8792), without regard to conflict-of-laws principles. You and FESMC agree to first attempt to resolve any dispute informally by contacting projects@fesmc.com.ph. If a dispute cannot be resolved informally within thirty (30) days, it will be submitted to the exclusive jurisdiction of the proper courts of Quezon City, Metro Manila, Philippines.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service, our practices, or legal requirements. We will update the "Last updated" date above and, for material changes, notify active subscribers by email before the change takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
